摘要
我国现行民事诉讼法虽然规定了缺席审判制度,但是随着民事案件的剧增,我国所规定的缺席审判制度已经不能顺应时代发展的脚步,无论从其立法层面还是司法实践层面都出现了不可忽视的缺陷.为了完善我国的民事审判制度,如何重新构建我国的缺席审判已经成为一个亟待解决的问题.本文第一部分介绍了缺席审判制度的含义、特征、作用和历史沿革；第二部分介绍了以英美为代表的普通法系和以德意为代表的大陆法系关于缺席审判的立法规定及与我国规定之比较；第三部分介绍了我国缺席审判制度的缺陷；第四部分介绍了笔者对我国缺席审判制度完善的建议.

China's current civil procedural law has stipulated the system of trial by default,but with the increase of civil cases,the trial by default system can not adapt to the pace of development of the times,regardless of from its legislation or judicial practice there are noticeable defects.In order to improve our civil trial system,how to reconstruct our trial by default has become an urgent problem to be solved.The first part of this paper introduces the system of trial by default in meaning,characteristic,function and history; the second part introduced to Britain and the United States on behalf of the common law and in Germany as the representative of the continental law system about the trial by default provisions of the legislation and China Provisions compared; the third part introduced our country the system of trial by default in defect; fourth introduced in the part of the author of the trial by default system perfect proposal.
