(c) We shall pay your company a fee for each project assigned to you. Such fee is exclusive of third party costs mentioned in Clause 6(a) above. Your company shall invoice us by the 10th of every month the unbilled fees of all projects finished in the previous month. During the contract period other remuneration methods may also be negotiated and agreed between you and us.
(d) To the extent that third party providers of production or other materials or services require royalties in relation to copyright or other intellectual property rights in addition to sums payable for such materials or services as such, you agree to negotiate with those third parties to agree the lowest royalty rate reasonably achievable. Following written approval by us of those agreed rates, you may pay the same and we undertake to reimburse you for such sums in accordance with Clause 6(a) above and to pay your company a fee in relation thereto at a rate to be agreed between us and you beforehand.
7 Payment
(a) We will settle all invoices issued by your company for services rendered and which are not subject to dispute within 30 days of our receipt thereof.
(b) Your company shall invoice us monthly for the cost of acquiring media space at the rates described in Clause 6 above.
(c) Each invoice shall set out the details of the services rendered and covered in that invoice. All invoices must be accompanied with the necessary supporting documents, for example suppliers’ invoices, etc.
(d) If a third party supplier offers a discount for prompt payment, your company shall notify us to enable us to make early payment to your company so that your company can take advantage of the discount and pass the savings to us.
(e) All invoices shall be denominated in RMB and shall be paid in RMB. Invoices for media purchased in foreign currency shall state the charging amount in foreign currency together with the conversion into RMB by reference to the relevant middle price of exchange rate quoted by Bank of Communications on the date of the invoice.
(f) We acknowledge that some suppliers require payment in advance. We agree to pay interim invoices in respect of such services upon your company’s presentation of such invoices to us.
